They apply them because they know they can. This was never about Simon and co holding their hands up and admitting they are wrong, it was never about a frank apology for the months/years of underpayments. It was simply how to resolve this issue, while paying out the bare minimum and making employees jump through hoops. I’m deeply unhappy the union didn’t put this to a member (instead of a branch ‘quick poll on Facebook’ vote) but at the same time I imagine the union probably bartered RM down to 8 hours, RM probably started off the negotiating much much higher.rambo1 wrote: ↑06 Oct 2021, 21:45I don't understand how they can apply rules retrospectively. They probably went off sick because they do so much bloomin docket for the company. Another shining example of how much Royal Mail and the Cwu thinks of it's workers.
I probably sound like an I’m alright jack, and I genuinely don’t mean to....I’ve loaned (interest free) some of my holiday pay to a colleague who didn’t receive any and is struggling. I hate seeing people shafted by this agreement, just like I hate seeing new starters put on the monster walks with no help, I hate seeing the senior staff hounded because it takes them longer to do a round. BUT....despite his nice guy image (which is slowly disappearing) Uncle Simon and Royal Mail are not our friends, if they were genuinely honest about a culture change and working together they’d pay every minute owed to everyone.
Start the ET claim. In future if you can get away with not needing to do OT, do it. And finally ask Dave and Terry the difficult questions - just why was this agreement rushed through, with my offices vote done via our Facebook group which only about 15% of our employees are part of.
The day is gonna come when we’re all gonna have to testify.

my points on this is agreement shouldnt have gone back the 2 years until staff was made aware of the criteria to be met going forward , and the 2 years back pay should have been paid to everybody regardless of the 8 hrs a month o/t , as when the company was paying out due to some of the e/t claims it wasnt based on this shite criteria of 8 hrs , and for me the 6 months that has just passed i did 74 hrs o/t but wont get nothing as because 1 month i only did 4 hours so when that is paid out in Nov i will put a claim into acas , and this new 6 month that has just started in October i will be on leave for 3 weeks as i was basically forced into taking my leave due to not being able to roll it over into next year so i will not hit the criteria again but heho i will just work my hours and go home so it will be an easy xmas for me

At least we all know now not to have more than a week off in any one period, try and split 2 weeks at end/start of a period. If you're unfortunately off sick ,work your day off at least one week that period. Amazed the CWU even passed this cowboy deal. Is going the acas et route free and simple or is it not worth the bother for £300 in (my case)?

"European" law states 4 weeks. CWU/RM have agreed a deal which will be ok for most people. The law overrides any agreement. I missed a 6 month period because I was on annual leave for 8 weeks. Essentially I was off a whole month & a week either side. I'm going to be off the whole of March 2022 cos they want me to use up my AL before the next year starts.
This is my opinion only as i'm no legal expert.
(1) I'll speak to my managers who will say its out of their hands.
(2) I'll next contact HR who will probably say the same thing.
(3) ACAS will give a certificate as its not one they can deal with. The 6 month period is 18months ago so I dont think they can actually do anything about it.
(4) Off to the ET if I have the courage or want to deal with the hassle for about £300.

This is exactly the type af apathy RM will be relying on.
Taking a case to ACAS is free, and not much hassle.
Chances are they will agree to pay off before it gets to court anyway, as they won't want to fight each batch of cases, knowing they will undoubtedly lose.

i missed my last qualifying period by 1 hour. i had p7=67.08 p8=101.99 p9 PASS p10=47.49 p11=37 and my last month i only had 7 hours in...p12=7...so over 250hrs overtime in= F*** ALL. pissed off is an understatement

going forward...how is it going to work for ''average pay'' on annual leave? are we getting it based on the same criteria? at least 8 hrs overtime a month minimum?

i was wondering if the dates were fixed, but guess those in both sets of crooks in the ivory towers will be bothered to tell us until too late,
but my reckoning this years would start on mon 5th apr, then every 4.33 weeks, but knowing them, the reset point will be midday on some occasions and still fail to qualify if in early or worked over
i've decided myself after taking the nov payment which is also nip & tuck if i qualified or not because of the lack of info to just use the acas way
at least it should be fairer

These are the next set of payment periods, from a union release back in the summer:
P7 27th Sept to 31st Oct
P8 1st Nov to 28th Nov

Which I’m assuming will be paid late May 2022.
