Dear Colleague

CWU APPEAL AGAINST HIGH COURT DECISION

The purpose of this LTB is to notify Branches that we are appealing against the decision of the High Court to award Royal Mail an injunction to invalidate our strike ballot.

The appeal will take place on Thursday 28th November 2019.

Further information will follow in due course.

In the meantime, any enquiries should be directed to Senior Deputy General Secretary’s Department sdgs@cwu.org.

if they lose appeal they will have wasted weeks when reballot should have taken place

let an injust verdict go without challenge, not just for us, but for all workers facing the likes of Rico

Because an appeal gives us an opportunity for ia before Christmas, a reballot is a minimum 6 week process, so just reballoting would have put us somewhere in the last week of December.

Watching it now. Who are the three judges? Are they likely to sympathise with us do you think?

Lord Justice Males - Used to be an Advocate and an arbitrator.
Lady Justice Simler - She is currently President of the Employment Appeal Tribunal and is a High Court Liaison Judge for Diversity.

Thanks Trueblue. The legal rep for Royal Mail is good.The union legal rep guy looks like He is struggling. :sad:

Just been watching that. Did they say when the ruling would be completed? i missed the end.

Yep, although the presiding judges did question some of his points, he is very polished. The CWU one had a lot of gaps and seemed to surrender some issues.
