If an employee has the CAPABILITY to do the job description and declines to do that job to the best of His/Her ability, that becomes a PERFORMANCE issue and a conduct/disciplinary matter and subject to the conduct code that can cause dismissal.

That might well be a policy decision, but I asked where it had been agreed with Collective bargaining and what agreement.

The publication also states that an employee's capability caused by laziness or misconduct is exempt from the procedure.

Will put it into Plain English
If an employee is being a Lazy Barsteward and not pull their weight then yes, they can be dismissed on performance and capability if no improvement is made. And my previous post was explicit in that an employee will be under a different process if they were under the DDA/Equality Act being a protected characteristic

That would not be capability.
They would be capable of doing the job to an acceptable standard, they would just be refusing to do the job to an acceptable standard.
That has nothing to do with capability or performance or workload or mail volumes or anything on this thread.
It would simply be refusing a reasonable request which is an entirely different thing.
