can anyone enlighten me on the procedure of booking holidays.... i have 92hrs carried from last year that i couldn't book and was told by a manager to book them this year... spoke to him in august and he said we will look in jan 2023 and have them then... i wasn't bothered when i had them so said ok.... now he is saying i cannot book any holidays in this financial year ending march 2023 and have to carry them over again. surely this is not right and illegal...can anyone advise that may know the procedure. i have put a grievance in but thats as good as a managers word(NOTHING). i would appreciate your input...

Working time regulations 1998,he must let you take the leave you have aquired in that financial year,if you want it all tell him,but they can dictate when they give it to you,i think royal mail do have a policy that allows you to carry over 5 days,hopefully a union rep can clarify

You're correct. I think there is a max you can actually carry over anyway and it's nowhere near 92hrs!! All you can take as in annual leave in that current leave year will be 28 paid days max under the Working Time Regulations according to your contracted hours.
Banked hours into the next years leave cycle will not apply and the employer can say no to requests. You agreed carrying over excess hours as a contractual entitlement, so the Working Time Regulations will not apply. Those regulations guarantee only 28 days in any 12 month period.
Carrying over leave is designed for five days max or longer for people on long term sick.
Now the bad news
If Royal Mail wanted to be utter barstewards they can delete any excess carried over leave with no compensation after a period of 18 months has passed.
Do not carry any leave over, insist on it and use the grievance procedure if necessary.

I've got a similar amount to use but the manager's been off sick for ages. I thought you could ask to be paid instead of taking it, or am I wrong?

Your manager cannot stop you taking leave this year, no space in the book etc is not your problem, you can take them to a tribunal and you will win. Put it in writing that you want your leave, as stated, they can tell you when to take it, you have no right to take it when you want it. Tell him, in writing, if you do not get your leave you will take him to a tribunal.
