Re: Scan in and out
Years ago before all your times we had a second delivery in between the first and second we had a meal relife break whatever you call it can they stop you using YOUR meal relife break. Well they have to give you a meal relife break by law it is yours you take it when you want the manager takes his her meal relife so you take yours!

Re: Scan in and out
That is incorrect.
the Working Time Directive states your manager can tell you when you can take your break.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

However they cant tell you to take it at the start or end of your shiftclashcityrocker wrote: ↑20 Oct 2022, 16:46That is incorrect.

So could a part timer with one half hour break in theory do what you suggest if they refused to take their break in the van?
If you tolerate this, then your paid break will be next

Re: Scan in and out
If someone suddenly, for no apparent reason, wants to take their full break mid shift it would scream to management that they were trying to ‘eat up’ time and game the SISO system.
Surely?
Surely?

Re: Scan in and out
Well obviously, the question is what they can do to stop it. Im assuming they would have some way of dealing with that ever happening but its an interesting question given up until now most of us took our last/only break off the end of our shift and left the building 20 mins early - that could be put to a stop with SISO if management insisted on no one leaving until the scheduled finish time.
They could be in a tricky situation where they cant force us to take a 20 break back at the office at the end of our shift but also cant really force us to take our break in the van.
Legally I dont actually know what they could do if everyone decided to return to the office halfway through the shift for either second break or full break ( depending on if FT or PT ) in the break room.
If you tolerate this, then your paid break will be next

No they can not just explain your condition as I have said and you can take your meal relife.clashcityrocker wrote: ↑20 Oct 2022, 16:46That is incorrect.

Can be should be equidistant ie "the break is taken in one go somewhere in the middle of the day (not at the beginning or end)" So some s**t faced manager tells me you have had your meal relief at 90 minutes and says your good to go for 6 hours 30 minutes. Really

The meal relief should be scheduled as part of the revision process. We have collective bargaining,
The office should vote on the revision. That is democracy.
I have worked in offices where the full 40 minutes was taken before delivery. Others where it was split 20/20.
If that is what the office has voted for, that is what everyone does.
It isn't a matter of personal choice.

Re: Scan in and out
Years ago we had P318s but the process is anyone can take a meal relife whenever thing is no ones ever done it half way through delivery hence why it has never been tested as in my first post. Yet can any employer refuse you the facilities and amenities of the business if gainfully employed by them and if they do not have arrangements it is required for the relief of other matters can they stop you in conducting your bodily actions? Can you not return to the office which they did not envisage a time without public conveniences!clashcityrocker wrote: ↑20 Oct 2022, 18:39That unfortunately is the reality.k979aaa wrote: ↑20 Oct 2022, 18:24

Taking breaks
Employers can say when employees take rest breaks during work time as long as:
the break is taken in one go somewhere in the middle of the day (not at the beginning or end)
workers are allowed to spend it away from their desk or workstation (ie away from where they actually work)
It doesn’t count as a rest break if an employer says an employee should go back to work before their break is finished.
Unless a worker’s employment contract says so, they don’t have the right to:
take smoking breaks
get paid for rest breaks

Two can they really stop you having a s**t?
Thirdly can any employer enforce all this if everybody does it?
