My IHR was denied by RM.. they said that there’s no offer for me because company has no money to blow off and condition can be healed within time and that I should be back at work when that will happen. Union said that RM has no obligation to pay me anything and it’s my choice whether I will stay off sick or go back to work..
as I’ve said I totally understand your struggle..
So what happens if you now go back to work but clearly can't do anything physical, do you remain on light duties indefinitely in the hope that you might eventually recover?

It seems another case of the CWU saying one thing, that IHR has been protected, but the company doing something totally different.

I have totally no idea how they work it out.. DOM said that I can get back to work on rehab (6weeks 2 weeks office, 4 weeks light duties) they can’t offer me different position as they don’t have any in whole north London..(!???) I’ve asked him to give me that in writing, still awaiting the response.. according to RM my injury is curable within time.. well, I think they hang me out to dry in there, as they no longer pay me , so they are not really concerned about my wellbeing .. it’s the form of constructive dismissal ..awaiting for me to hand my notice and the problem is solved.

Just a update, after 13 months since my accident, RM an OH have agreed that I qualify for IHR an I’m just waiting on hr to send quote an to go in an sign the paper work ect .

So when did RM become a back specialist?
Most back injuries are due to degenerative conditions (wear and tear) bulging disc pressing near a nerve and are not easily fixed, may improve ,maybe not without surgery.
Obviously ,RM are being tightass# hoping you will just quit without a pay off.

Hope your back does improve though.

Suggestion - play them at their game.

Speak to your Doctor / GP, explain the situation and I’m sure they’ll assist in providing a “unfit/fit for work note” specifically detailing all related job actions you CANNOT physically perform.

I suspect you can come up with a list that prevents doing almost all tasks within delivery office!

Then hand that in and then turn up to work.

It’s then down to your manager / the company to decide what work you do - if any - but of course if you turn up for work you should then be getting paid!

Wonder what the legal stance is regarding ihr ? Seems RM are riding roughshod over anything these days, and don't believe anyone is really sick, whether the medical professionals claim or not. Good luck with all ongoing cases, we were asked if we had any illness that may stop us from working - to be told that certain things weren't on their list.
