IHR , has been rejected ,

Post by FATPAT »

recently had my IHR rejected by senior HR, Iv been told by my manager.
I have currently been off for 30 plus weeks after a serous accident,
i have multilayered injuries/ disabilities. A did return for a short while after 6 months , but was struggling on a daily basis. An have now gone back off.
An then applied for ihr. Which I was told was rejected. Yet my occupancy health assessment, has said I’m unable to return in any capacity a there no work life changes can be make to assist a return, an no time scale, an I’m getting closer to no pay , unsure what the next step is for me. Been there for almost 30 years . if there any advice any one may have would be appreciated

Get area rep or branch on it...if you cant do anything in any capacity then you actually should be recommended for ihr...have you had your phone call off ohs?....this is the first step to ihr...sounds they are trying to get to down to zero pay and force you out or return....if you are unable to carry out even light duties then there is no reason why it should be rejected.

On what grounds was it rejected? Have you actually seen HR's response?

I was put forward for ihr but has been rejected by hr. The reason why hasn’t been disclosed , but the physician doctor has said I met the criteria to qualify for ihr , so I’m unable to return or leave with any payment atm, which is frustrating,

Would have thought that they should give you a reason.Get your union rep on to this straight away.your line manager /com should be helping you to resolve this too.

if you meet the criteria there is no reason why it shouldn't be granted. take it higher than the office rep. go to area or branch. they are taking the piss.

Incredible. I think HR forget what the H stands for.
’You can't just ask customers what they want and then try to give that to them. By the time you get it built, they'll want something new.’

Surely you have to see the letter of rejection yourself? Ask for a copy! Don't proceed any further without doing so. If your line manager won't give it to you, phone HR themselves and ask for one.
And if it genuinely has been rejected, then appeal.

Rejections do occur on a reg basis, however you should have had a copy of said letter.
This can be reversed using your Doctors opinion as evidence.

Do you know jb 1969 where the com/line manager sends the occupational health to.I’m in the process myself of seeking I H R and the com received my initial report from OHR and thought it wasn’t worth trying to get I H R from what they said. It was a contradictory report saying in parts I wasn’t fit enough to return in the future but then said I could make a recovery which didn’t help as I don’t think I will for work purposes.

Your line Manager should supply you with a copy of OH Report.
It’s then up to you whether you get Rep involved.
The OH report will get passed on to his/her boss & a decision will be made there.
The problem with these OH reports appears to be lack of experience with those interviewing you.
It can only take one sentence within report to ruin the opportunity for Medical.
But as I said, the onus is now on you & your own Doctor to provide evidence contradicting what report says.
Dealt with two cases, both where similar.

Sorry to hear about your troubles:-(
I’m in very similar situation, been off sick with back injury for 8 months now.. they stopped my pay in February ..OH stated that I’m unfit for work at any capacity, doctors are saying the same.. My IHR was denied by RM.. they said that there’s no offer for me because company has no money to blow off and condition can be healed within time and that I should be back at work when that will happen. Union said that RM has no obligation to pay me anything and it’s my choice whether I will stay off sick or go back to work..
as I’ve said I totally understand your struggle..
