Losing your pension if sacked?

Post by wacko74 »

just an idle query, but when you hear about people being sacked and ''losing their pension'' do they actually still get back the contributions they've made over the years or do they have everything forfeited?

I may be wrong but you can't lose any of your pension that you have accrued at the point of dismissal unless you are sacked for a criminal act, and the judge at the trial finds you guilty and issues a judgement to that effect.

Your pension is frozen at that point as I understand it.

However, someone incorrectly dismissed may be entitled to some form of compensation if his pension is affected by the unfair dismissal, which would be decided by the tribunal.

Very few if any lose their pension through dismissal. Some companies might seek recompense through the courts in the case of major fraud or such like.

Interesting, I always assumed you would lose at least all the employer contributions and any investment gains your pot had made to date and you would literally just get back the contributions you've put in.

Your pension could be affected if the judge orders a proceeds of crime compensation against financial losses from theft or fraud.
