But CWU lawyers argued there was no evidence of interference with the ballot and that "legitimate partisan campaigning" by the union in favour of a "yes" vote did not violate the rules.
In the High Court, Mr Justice Swift said in his judgement: "This was an interference that was accurately described as improper. Strike ballots should be postal ballots. Each voter should receive a voting paper at home.
"What CWU did was a form of subversion of the ballot process. It was an interference with voting."

Another bent judge always working with the establishment, i wonder if the time has come for workers to get some balls and tell them to shove their overtime ,guarantee it would be a complete mess within days.But i won't hold my breath the worker of today will roll over and have their tummy tickled but still carry on moaning ,our forefathers would be ashamed .I'm just hoping that one day people will come before money and we actually start to stand up for ourselves.

The CWU should request its members refuse to do any overtime - either now and till xmas or maybe the week following black Friday/cyber Monday and other targeted weeks in the xmas build up, our D/O would grind to a halt lol
Also, we in our DO have already delivered election cards, they are addressed and we had 3 days to deliver across our walks, sat/mon and yesterday, tues, obviously not all have had them yet?
Do we have to deliver the no doubt to follow flyers if they are not addressed?
I will not do any extra days or any OT from Monday, hope more will follow, at least on selected weeks....

How parliament operates and the issue of Brexit are also outside the remit of the courts but thanks to the intervention of one migrant a spanner was thrown in the works. The latest general election is a consequence of that. I think an official strike at RM within a general election timeframe would have been stopped no matter what but the idiots using social media gave RM the ammunition to do it. People in this country are famous for not complaining. I saw at least one postie write on this site that they felt intimidated by the activities of persons 'encouraging' them to vote Yes on the ballot paper in the delivery office. Absolutely citing the GW is totally outside the remit of this judge and so CWU should appeal on those terms.
If we went straight to a new strike ballot for two weeks instead of pursuing an appeal then gave the two weeks notice we could be in industrial action by the early middle of December. If we go for an appeal then the view of Emma Simpson from the BBC will probably be the case and there will be no IA until the new year. A strike in the new year will be fairly ineffective and probably not worth doing.

You can refuse to deliver them if you find parties views objectionable but you would be moved onto another walk while they were delivered on your walk.
Aside from the majority part time contingent of RM staff always clamouring for more overtime a collective refusal to do overtime would be seen as 'work to rule' by RM and there would be serious consequences.

Won't happen. There's too many part time employees who apparently signed up not knowing how many hours they would be working and therefore rely on overtime. The CWU should not have to call to stop doing overtime if the 97% of people who voted yes had any self respect they would not be doing any as soon as they took us to court. Disappointing set of events given the history of the last prospective strike action. Hopefully this will reinforce the determination to fight against Rico's approach and not the opposite, CWU need to respond accordingly, please don't waste time appealing this verdict. I know f@ all about law but felt a bit uncomfortable with some of the posts on social media which I'm sure were well intentioned, but ultimately the CWU should have distanced themselves from rather than endorsing/ promoting. Is there stil the timeframe to still get a strike in before xmas?

Seems to me an overtime ban (self imposed, rather than union led) keeps a wage coming in and makes an important point, RM cant operate without o/t. Still, Im sure the usual suspects would use it as an excuse to get even more overtime, all the time complaining about RM!

I retired 4 years ago after 25 years service, was in a couple of walkouts and a national strike. With the advent of xmas and a general election during the same period I think the injunction, in this political climate, was a foregone conclusion. In my experience if you give RM a molehill they'll make a mountain out of it.
