Quick questions on toilet faccilities and start time insurance,

Hello all !
Could anyone tell me what RMs official policy is for toilette relief when out on our deliveries ( keep it clean ! :) )
Also on the situation on people who come in before their start times as regrds being insured ? It used to be 10 mins before your duty started.

Your walk log should indicate any approved location(s).

A member of the public, (even a burglar), is covered by the Employers insurance(s), what makes you think that an Employee isn't covered at all times whilst on the premises?

You 'should' have designated toilet stops on all duties.
A petrol garage, cafe (with the agreement of the owners) post offices,subbies (with the agreement of the management ) the list could be endless ect ect.

If you have to drive/go off route to said toilet facility then so be it.
All walk logs 'should' be updated to said toilet stops.
This 'should' of all been done during revisions, and regularly double checked.

There is a lot of 'shoulds' in this job...

The other thing, clip round the ear of the flyers should suffice!

It "could" be considered them being illegal in not providing welfare facilities. Particularly for females as it could be considered gender discrimination

Welfare facilities & Toilets
Due to the potential for delivery staff to be away from their unit for extended periods of time
it is necessary to ensure there is suitable and sufficient access to welfare facilities particularly
sanitary conveniences. Access to toilets is a human right – doing without is not an option and
where there are no toilets available on the delivery walk or adjacent delivery walks then a
return to the unit is necessary.

.... and no they can't force you to complete delivery on overtime, if you have to return to the office to use the welfare facilities.

The question of insurance is not whether someone in the building early is insured, obviously they are. The question is how much injury compensation you could expect if the employer could prove that you shouldn't have been there when the accident occurred.

Injury payouts are normally determined on how much of it was your fault and how much was the employers, in a case like this I think their lawyers would be laughing at you all day.

On the flipside if you're in before your start time and you cause an accident that injurs another member of staff you could be in more s**t than you can imagine, not only will the business disavow you and throw the book at you to protect themselves it might also be that the lawyers will then come after you.

All in all you may be covered by employer liability insurance but because of your own actions on a personal level you might as well not be.

When we had our revision I spoke to 3 planners on the issue of convenience breaks, the response from them were as follows - Go in a bottle - do what you've been doing for the past 10 years you've been working here - if you need to use the toilet it'll have to be in your own time or before you leave the office to go on your duty!
