Hello everyone, im new to this forum :)
I have been a postman for last 2 years. I recently had a shin splint and was adviced by doctor not to walk too much at work. I selfcert my first seven days and after that he gave me a note saying not to walk more than 20mins at a time. I showed this to my manager and was assured that I wont be doing a walk the following day. When i turned up I was put on a walk straightaway and was told to rest every 20mins. I ended that day with severe pain and went back to my doctor. He wrote another note saying that im not fit for work for 2 months. Now i have been off work for 3 weeks. Manager rings me this morning and asks me to come to work from next week and says i will only be prepping. He wants to me start at 5 in the morning and finish at 11.
I am just a bit concerned. I am not too sure if I should go against my doctor's note. By the way my pain is still there but not as bad as it was. pain is still there not completely gone yet. I fear that pain might come back if i walk or even stand for 6hours. I still have 1month left to rest according to doctor's notice. In the meantime my manager promised me that he will refer me to ATOS. But I havent heard from them yet. Just curious how long it would take ATOS to ring me and assess my situation. Any advice of returning to work or not would be grateful.

Take doctors advise your manager cannot overrule a doctor's line if you go back to doctor with same problem and tell him it's because you went back to work early he,'ll want to know

A GP and occupational health report can be override by Royal Mail, and they do. That was why the "FIT NOTE" replaced the old "Sick note"
A report from a specialist or consultant is a different matter.
If the employee suffers any detriment by being forced into work against doctors advice will be a win, win, situation at any tribunal

Your manager or couldn't give Atos cannot override your GP
Although most GPs are NOT occupational health trained,but neither are Atos especially those on the end of a phone the ones that you cannot understand.
Only those Atos consultants who attend face to face interviews normally are. If you insist on a face to face due to inconsistencies or serious health conditions or health worries insist on a face to face it cost RM a small fortune and you will be better advised although the management will ask the Atos advisor pre loaded questions that are there for a one way street in RMs favour. But in the past I have had Atos advisors overrule and go against what the management have ask the advisers purely because of serious consequenceies if any exacerbated injuries were to happen.
Besides your GP holds the field regardless of and managers insisting that it is ok for you to attend work. Nonsense.
On or before your return to work insist on an Atos rehabilitation plan which stipulates your build up in hours he over a 6-8 week period which can be as little as starting back to work on an hour per day, yes 1hour. Your rehab plan must be what is right for you remember that if management can eliminate any further sickness H&S is bonus related for managers regardless of what they say that it isn't it is. Once your back to work you can revert back to hour age from the previous week if that you think that you are doing to much. Atos can work in our/your favour if applied right,plus you are normally covered by the equality act 2010 the old DDA act whilst injuries persist especially if it is re: an accident at work.
Which when returning should be discounted re stage warnings if it can be proven that you or the individual in question never contributed to their own accident. Under the new attendance procedure. Return to work talks should take place on your return to work. And the Atos report should meticulously include your capabilities, it is important to remember also that individuals must take care of their own responsibilities as well. RM have a duty of care don't be taken in by wrong information by ANY managers,always seek advice from your rep/or Area rep or the CAB citizens advice.
Failure to comply in insisting that you are fit for work by harassment & over riding a professional, especially a doctor, this ignorant behaviour could and may render RM liable for an ET or IT,if harm was to come regardless of ignorance as the PIC person in charge, RM managers can also be prosecuted if any advertise arise through injuries.

Also watch out for mangers insisting on you coming back to work against your doctors request. Eg if you are coming up to half pay 6 months off and your doctor has signed you off then get a fit note before you return or you will be uninsured regardless of any national insurance being paid especially if you injure yourself. As you have gone against a medical professional advice,also remember if you return against a doctors note then go off sick again through exacerbating your own injury You will more than Likely trigger another stage warning. It may be prudent to get in writing off of your manager if they wished you to return to work due to coming up to 6 months eg operations being cancelled and weeks being delayed for the op,so that your recovery period is fully paid after the operation that any stage warnings will be discounted. If your manager is that hell bent & bothered by getting you back to work then there cannot be any problem with him putting in writing your simple request of discounting any further absence if you cannot attend through further injury whilst returning early. If they refuse your request them stay off work until that you & the Doc render you fully fit for work. That is if you can afford to be off.

Unless you are qualified in Health and safety or Occupational Health, let alone Royal Mails own internal absence procedure, then i would refrain from making comments that can have a negative consequence on the employee
