If as you have mentioned that there are forms to fill out then at the time of your accident you did not complete any form then it is more than likely that your accident has not been recorded.bigbazza19 wrote:How do I find out if my manager at the time 2012 reported my accident ? Since the accident occurred in 2012 and you have 3 years to submit a claim for compensation is that the reason for your posting ?
You can ask for a claim form if this is the case but not having completed the necessary forms at the time to pursue your claim for compensation maybe more difficult.
You can enquire through your line manager if your accident was recorded in the accident book at the time and you should have made it clear to your manager that you wish this to be recorded but again as no forms completed I doubt very much if this has been done.
Did you go absent due to this accident and if you breached the attendance procedure as a result and RM discounted this as an accident at work then this may be to your advantage but you will need to check.
If this has happened then get your union rep if you are now a member to follow this up on your behalf,

It is the responsibility of the business to record accidents if the business becomes aware. They have a statutory duty to record all work place accidents
The injured party has three years to submit a claim to the court to claim any possible redress from day of accident, not three years since the accident

The 3 year time limit IS from the date of the accident but I wondered how " BIGBAZZA 19" was asking questions on an accident that happened in 2012 and is he was considering a claim for compensation.gluteus maximus wrote:It is the responsibility of the business to record accidents if the business becomes aware. My posting did not mean he has to wait 3 years before he can submit a claim and hope that my information did not give this impression.
Your employer is legally bound to record all accidents at work and there is the necessary forms to be completed as the result of the accident.
As " BIGBAZZA 19" has made an enquiry as to the forms then I am taking it that as these forms were not produced to him at the time of the accident then there is the possibility that the line manger has failed to record this in the accident book,
If this is the case then 2 years on from the accident it prove difficult to prove an accident in fact did occur hence my posting on the recording of the absence if any as a result of this accident.

If the accident has not been recorded then there is nothing stopping you from requesting it be recorded now into the Accident reporting process, and they cannot refuse as it will be a breach of statutory duty. You also need to contact thye DWP and record it as an industrial injury
