Complaints Not Made in Good Faith

Complaints that are not made in good faith undermine the validity of the whole
investigation process and damage the basis of good working relationships.

While a guiding principle of the Bullying and Harassment procedure is that
managers will treat all complaints seriously, there is an obligation upon all
employees that complaints must be made in good faith.

On completion of an investigation, where an investigator believes there is evidence
to suggest that a complaint was not made in good faith, s/he must decide whether
the complaint was so made.

For a complaint to be deemed as not made in good faith there must be reasonable
grounds for belief with supporting evidence. For example, where a complaint is
brought that is untrue and/or aims to annoy, irritate, distress, damage or otherwise
harm the reputation and/or integrity of the person against whom it has been made.

If it is found that a complaint has not been brought in good faith, appropriate action
may be taken under the Conduct Code, which may include dismissal.

Where it is believed that the complaint was not made in good faith, the investigator
will:

• Compile a summary of supporting evidence, clearly stating why they believe
that the complaint was so made,

• Inform the Complainant of the outcome of the harassment investigation and
that s/he believes there is evidence to suggest that the complaint was not
made in good faith, and

• Forward the summary and the original case papers to the relevant RCM.

• The RCM will use the summary only to decide whether the case should be
dealt with under the Conduct Code.

NB: The original Investigating Manager will not undertake the investigation of the
Conduct case. (Standard Complainant Letter 28 applies).

We weren't told why the 2 girls were sacked. I think one of them was told she wasn't suitable for the job after a 3 month trial and the second one just disappeared. Sorry I can't shed any more light on the situation.

Our union bloke dont seem to be doing anything about the bullying that is going on in our office is there someone else i can go to about this ?

Dont hold your breath , RM just runs rings around it all , my case went up to CWU headquarters , CWU PEC member spoke to opposite RM Manager , now it is back to local level with nothing being discussed in the failures of RM and i now have got to attend a mediation meeting tomorrow to tell my manager( who has not been my manager now for 6 months how i feel , Like as if I have not done this over and over again in the last 3yrs WTF

No consolation I know but this is an issue that impacts on employees of many other industries and it seems that many of the cases follow a similar well trodden path. In house investigation and mediation doesn't work and HR aren't on 'your side' they are about as objective and independent as their monthly pay-cheques will allow, and that's on a good day. RM Employees are fortunate in the respect that in comparison to many other groups they are well represented by a union that is strong and stands up for their rights, think of how it would be without them. 'Independent' mediators have now been employed by RM but I wouldn't hold your breath. Employees need to have access to an independent service that investigates cases of B&H objectively, passes judgement and has the power to impose meaningful penalties, it happens with Health & Safety so why not B&H?

The only way to defeat bullying and harrassment is a united office, all doing the job by the book and refusing to go over, they can't do the entire office, its the only way is a united office standing shoulder to shoulder putting the stress on the managers, let them run around like a blue assed fly covering deliveries.

It depends on your Branch and the circumstances.
Some Branches apparently have a rule that you cannot expect union representation until you have been a member for a certain length of time but this is in place to prevent people joining for help after being conducted.
I'm not sure if it is a hard and fast rule anyway.
A rep can always accompany you as a friend/colleague if they so choose rather than in their formal capacity as a rep.

It would be best to talk to a rep and see what they think about your circumstances.

bullying and harassment is everwher here in birmingham
walks cant be completed#
its so obvious that u put two walks together and add half a parcel delivery to it u wont complete
been in van share for 5 months, book overtime everyday
managers try everything to blame us but they know its a mess
as a ps re the sun newspapers over 2 days , why dont we all say i will work to my time, lets stick together.

What is the procedure to make a complaint about bullying as I've read that I should try and sort it out first with the person in question which is a definite no no, do I just ring the number on my payslip or can I email them ? Thanks in advance for any help

When we started collapsing walks, it was said to be for light days only, and only one walk was collapsed. We now collapse every day, usually two or three walks, but occasionally four - but even if we say we won't have time to do it, we are still pressured into taking it :sad:
