No doubt they are waiting on the result of the ballot, then o expect the union will be very vocal (if it is a big yes on the ballot that is).

Well for a start the union will never agree to RM paying this to strikke breakers , while the rest of us are left out.
We would not call strikes off while these terms where on the table, unless they paid the strikers £400 and a compromised agreement was in place.
It would cause to much trouble in the work place and the best of it is Senior negotiators on both sides know it won't' happen, Moya knows it too.
Look at it another way, what would happen if she paid it. Would the union members turn on the union?

I think if that was the case you would have seen a face saving deal by now.
If the union cannot secure a yes vote we're all screwed.That would signal open season on the union and its members.

Oh I think they will, even without the issues at hand there is a great deal of unrest particularly in deliveries who feel that despite 2010 being a poor deal RM have reneged on the spirit of the agreement and have used the so called "new relationship" to their advantage - which is not to say the union are blameless in the situation we find ourselves in but it would be foolish not to support the IA at this juncture.

There is a word of caution for the union though, very many people in our office have clearly stated they will support IA but if they feel that there has been a back door deal agreed they will pull out of the CWU for good. TBH the response from the union so far doesn't exactly instil confidence in the troops.

As far as it has gone is not the disenchantment not with the union but with our working practices? Those who think they can shift time like doctor who come in early and go home early. Will not clocking in and out solve this problem after all we are paid to work our hours and if over time is needed their is a record of it as managers have long since departed the office!.

One thing that will annoy me after all this is if any pay deal isn't back dated to April, I realise there is a lot more on the table than just this but its one of those things that has ate away at me after the last ' deal of the century' when it wasn't and I felt seriously shafted again.....it's like even at the original offer we are already owed over £250 or round abouts so I just hope the union makes sure it is back dated to then and not come back with some amazing deal of £500 (which would be less than back pay + the 300 originally offered)

Can you discriminate against someone if you offer it to everyone. Surely in law you would have a choice to make your own choices..

always is back dated just as the three year protections no doubt so less than two and a half to go!

She didn't offer to everyone, she offered it to those who come christmas had not been on strike. But she did it during a ballot for Industrial Action, thereby attempting to influence the outcome - this is at the very least questionable. But the biggest point is that you cannot discriminate against someone taking lawful IA - if you offer a bonus to those breaking a strike but not those who do, then that is probably discrimination.

Will they get it paid if they don't go on strike or will they have to strike to get it like unpaid overtime?.

It won't be going to a Court, the CWU aren't that gullible and RM understand only too well what the potential consequences on the shop floor could be. There will be a compromise whereby everyone will be paid. The strike breakers won't have lost out financially and the strikers will be enticed to agree to a deal on the strength of a windfall. The reality of course will be the £300 for strike breakers will be at a considerable cost to their self esteem.
