The CWU has been mandated via a passed motion at the POLICY FORUM – JULY/AUGUST 2013
"Due to the “Growth & Infrastructure Act 2013” coming to the attention of our members, the NEC will obtain a report from an appropriate Barrister in how this legislation would affect the Union and its members in the future if free shares were issued.

This report will also outline any potential impact on the individual. This report will be circulated to the membership no later than 30th September 2013.

Royal Mail have given a deadline of the 7th Oct 2013 for return of opt outs.

So the time between the mandated deadline of reporting to members and Royal Mail's opt out is very tight.
I have requested to Dave Ward and Billy Hayes that this barrister's report be made available asap by the 30th Sept.
Let's hope we receive it, so we can make an informed decision, once and for all as to whether the "Growth and Infrastructure Act 2013" applies in this instance.

Regarding the free shares, do the union wants us to opt out or accept? I am a bit confused on this matter

Dear Colleague


Government Employee Share Offer


We have received numerous enquiries as to whether CWU members should opt out of the Government offer of free shares, which is dependent on the privatisation of the Royal Mail Group.


The CWU position on this matter has been consistent since the Government first announced their plans. It would be wrong for the Union to advise members to opt out of receiving free shares. This is a matter for individual members to determine.


The CWU continues to be fundamentally opposed to privatisation. It remains our view that legal protections, pay, pensions, workplace issues and a strategy for growth, are all far more important to the future of CWU members than free shares.


On the question of any impact of the Growth and Infrastructure Act 2013 and the potential surrender of employment rights, the advice of our Lawyers is that employment rights are not affected by this scheme. We are preparing a full report on this aspect in line with the amendment carried at the July Policy Forum.

This is the "barrister" report I want urgently after the 30th Sept, as opt out cut off is the 7th oct (Mon 9am)

My reply
Dear Lionel, Thanks for your reply.
Is this the Barrister's report that was mandated at the Policy forum?
Could it be published on or as near to the 30th Oct as possible.
I and we only have until 9 am on the 7th Oct to "opt out" of the shares.
So the LTB must not be published any later then friday 27th and that's pushing it.
The conference mandate is for it to be published no later then the 30th.
I want time to read it and decide and then manage to get my "opt out " form back in time.
