assault from a postperson help!

:sad: I am not a post person but i have had a hurrendous weekend,i was assaulted in an unprovoked attack twice by the same person,i called the police and they took a statement and photos of my injuries arrested them they admitted evrything and they cautioned them and let them go..................because she had never offended before.........i have chatted with royal mail and they wee very understanding and told me to call their manager and make them aware of whats happened i dont know what to do i have had to take time off and explain to my employer what has happened she cant beleive she was not charged!!!!
please any advice cheers

sorry that makes no sense what so ever,you keep saying they,then change to she,you say you have been to the police but they have done nothing then you say you have been to royal mail,and told to go to the manager concerned,have you done this,was it concerned with work or a private problem,what exactly are you wanting

Masie, Welcome to the site and i hope your ok now and not to hurt...

If the police have been called then that is all i can say to you but the fact they released the person you say attacked is just the state of the country now days...

Get a brief and file for damages and take it further... Go to the Citizens advice center local to you they will help you and tell your best way to go about it...

Not sure if you can do anything to be honest you said they were cautioned - this is classed as a punishment:

Cautioning

A caution is a warning given by the police to adults who admit they are guilty of an (often first-time) minor offence, such as vandalism or petty theft. A caution acts as a first official warning and deterrent to anyone from getting involved in crime.
Also unless the postie was in uniform or it was connected with their job then Royal Mail should not get involved.

However, you may have recourse to a civil suit perhaps you should visit one of those No Win No fee Solicitors.

I thankyou for your time,i just feel that when you are in a job dealing with the public you represent a company,would she have been employed if she had a criminal record.
When i say they her boyfriend is also a postie at a different office he threw the beer in my eyes and she attacked me,when i said about going to the manager i feel he should be aware what she is capable of and i said something in her company which was very empowering as her dad had an accident some years ago, all i said was how well her dad was doing and i had seen him while i was working in the community she argued that her dad is deaf which is true but in his own way he communicated with the person and managed to order a meal then she started shouting at me saying i was lying her dad was deaf i said yes i know but can communicate then i mentioned i wrked within a role where i promote independence especially if people can function to the best of their ablity as soon as i said that she knew i worked for social services and he started and then it went wrong she was asked to leave she had been in there all day and then ran back in and started again.

Thanks, i have got an emil from my Mp so she can ask why no charge it was quite brutal and i have 2 black eyes and feel terrible my partner wants to go round but he will be charged but you can undrstand why some dont call the police,i will be taking it to court but i feel that if she went for a job as a postie with a criminal record she would not get it,why shoud she go to work and i have to stay home because she did this!

Masie... I think you could get all you need at the CITIZENS ADVICE CENTER LOCAL TO YOU.... They will give you all the advice thay can... Without FACTS we cant comment as it will be infringing the Official Secrets Act that we all signed... Sorry if you are in pain and i hope you get better soon....

She was not in uniform but when you work for such a public company you are representing work and should be able to what you like outside work,we all get drunk and every one has done something they regret but would royal mail employ her if she had a criminalrecord?I feel her boss should know as i have had to tell my boss she appears like she hasn't a care in the world she lives in the next street and i am becoming frustrated that this has not made any impact on her life.

Hi thanks again i kknow about the official secrets act as my mum was the first postwoman where i live,when it was the gpo then i have rang the police again but no callback,what if she has done this before and nobody pressed charges this might be her weekend hobby!

I presume from your subsequent statements that the person who assaulted you is a postwoman.

The alleged assault took place outside of her workplace in a pub.

You have reported it to the Police who have cautioned her. So I would assume then you have been given a case number from which you would be able to claim criminal injuries - BUT - I think that is only if the alleged assailant is charged and found guilty. The Police obviously didn't consider the situation warranted a charge because of the circumstances, of which we have heard only one side.

What I'm not too clear about is why you think it is the business of Royal Mail. From my experience the number of fights outside of work involving postmen would clear most delivery offices of 25% of staff if it was considered they were a danger to the public..

Hi Thanks for your time and yes there is always 2 sides and off course i am the injured party and feel that whatever the circumstances it was unprovoked she admitted it and it did warrant a charge but because she had not been charged before they gace her a caution and as i have said before we have all done silly things on alcohol and bcause it was a saturday evening in the pub its very easy for people to judge thats why i was at first not going to involve the police but due to my injuries i did not provoke her and i have a copy of the cctv and its plain for all to see that i was attacked twice,i went into the pub and ordered 1 bottle of wine i was meeting my fella in there and we were going to eat somewhere but did not get the chance!

Hi Thanks for giving so much time on my issues with this,as she was not charged does this mean she is innocent,when there is very strong evidence including a cctv tape which i have witnessed today and a statement from the landlady involved saying that this person was the agressor and because this is her first offence then she has been cautioned and now has a criminal record so looks like she has made a very costly assault, so i was a member of the public in a public place and i was attacked twice by someone who represents royal mail just as i reprsent social services if i attacked or abused someone for no reason my employers would be told and i would be struck off as you should be setting and example.
Although we think its her only offence this may be the only one she has been reported for!
I thankyou for allyour comments and hope i have explained to you in more detail.
I am intalks with royal mail and my slicitors to see if we can let her manager know,thank you

you obviously know this family but that does not give you the right to start an argument about someones father.although i feel sorry for the fact that you have been injured there are sometimes when your opinions should be kept to yourself .its not your place to comment on someones family.and why inform royal mail of this unless you are hoping that this person loses their job. in which case you are just vindictive. like was said in a previous reply we only have your side of the story.

As an outsider looking in I have to say, Maisie, there appears to be a lot more to this story than you are revealing. The person who allegedly assaulted you was not representing Royal Mail. She was a private individual in a public place. Had she been in uniform and going about her duties for Royal Mail at the time then of course it would have been a different issue. If you feel that justice has not been done then your argument is with the Police. I am actually surprised a solicitor is even taking issue with Royal Mail as it isn't any of their business.
