privatisation payoffs..

Post by pants123 »

i've worked for ROYAL MAIL for 20 years,,, and i was wondering when ROYAL MAIL gets privatised,, will they keep me employed under the current terms and conditions agreed with the union, and be on the same pay,,, or will the NEW OWNER just put me on a new terms and condition with lower pay.. IS THIS LEGAL TO DO SO..
also will it be the same senario as BT,, pay off current staff to leave and then employ cheaper labour..
I fear for the future,, as many of my colleagues also do..
any advice would be gratefully appriciated..

Anyone interested in this would need to research TUPE to get a full understanding. Transfer of Undertakings (Protection of Emplyment) http://www.berr.gov.uk/files/file20761.pdf" onclick="window.open(this.href);return false;

However broadly speaking they cant make changes to out terms and conditions on transfer without agreement from us. Pensions are a bit more complicated and I would hope that the CWU would advise us on the liklehood and legality of any changes there, and of course on the whole transfer as well.

Funnily enough i just had an email from Carolyn Jones... :whistle

TWO TUPE Conferences. BOOK YOUR PLACE NOW!
TUPE Update: your questions answered

Tuesday 28th June 2011
Hamilton House
London

Tuesday 12th July 2011
Adelphi Hotel
Liverpool

Stay well informed - book your conference place now.

30 years after their introduction, the TUPE Regulations (Transfer of Undertakings Protection of Employment), are still one of the more complex and difficult areas of employment law.

The original aim of the Regulations was to strengthen the rights of workers involved in transfers, providing them with continuity of employment and the same terms and conditions. But, over the years, TUPE has been interpreted by the courts, both in the UK and in the European Court of Justice, and increasingly case law determines how the regulations are applied.

Whether you want to improve your understanding of when TUPE applies, the implications for pensions, or the impacts on information and consultation rights and collective agreements – this conference will help.

The conference will provide an opportunity for you to update your knowledge, put your questions direct to TUPE experts, and have a foretaste of the Institute’s new handbook on the TUPE Regulations.

The day will be led by Richard Arthur of Thompsons Solicitors – an acknowledged expert on the TUPE Regulations and author of the latest IER publication on TUPE. We will also have some real-life practical experiences of TUPE from trade unions and other practitioners (see programme)

Booking Form and TUPE Question form attached

Or book and pay on our website

COSTS
£75 IER subscribers and members :nervous
£90 Trade Unions
£220 Commercial

PLEASE NOTE: the cost of the conference does not include lunch :left:
good times, bad times you know I've had my share

if we wee to go down the provatisation route then surely one thing the union would insist on is to keep the same contracts.......otherwise there would defo be a strike.

that would harm the selling process.

I've been here before. The new company offers a lump sum (£2000 in the case of London Buses) to employees to alter their terms and conditions.

Most employees vote to take the lump sum (short sightedness) and thats it, you are on vastly inferior wages, sick pay etc.

I saw my weekly wage almost halve on some weeks (it depended on which shift you were on) and the same people that had voted it in were moaning about it within a month! :arrrghhh

Not exactly as you would be paid the same amount if paid weekly or monthly, this happened to myself at a previous employer and it saves the employer money. The link you displayed is for something different from what I am suggesting.

How likely this will happens.

Will they offer a huge bribe to accept new deals. Are they allow to sack everyone and re hire people in their terms

Didn't TNT sack all the posties in Holland because they went on a 'illegal' strike so they were left to the mercy of the wolves, only to be ri-instated the following week as PART TIMERS!. If there is no EU to protect us which is disputable in any case, then what ever law protects our conditions in the UK, there will be some smart arse lawyer who will find a way around it.
My bet is that the new owner will offer a cash bribe to sell not only ALL of our PAY and CONDITIONS, but also as with GCHQ, they may even get you to either sell YOUR UNION RIGHTS or sign a NO STRIKE AGREEMENT. :vcfo :dcfo :ncfo
