LTB 1043/10 - Burslem

Post by brothermagrew »

LTB No: 1043/2010 Ref: 30000a 26th November 2010

To: All Branches with Postal Members

Dear Colleague

Burslem
Following consultation with our lawyers and the members directly involved, we have concluded that there are no grounds for appeal against the Employment Tribunal decision. This is because successful Employment Tribunal appeals can only be based on points of law.

We have now reached a point where the members directly involved believe that it is time for all of us to move on. As a final demonstration of our support we have agreed, in conjunction with the Midlands Region, to put in place the following measures.

• The existing financial appeal which has been supported by Branches through a direct debit scheme should continue until the end of this year. CWU HQ will immediately provide the members concerned with an advanced lump sum as a final payment from the Branch supported scheme.

• The union will provide all available support to assist the members concerned in helping them adjust to the future. This will also include providing advice and support in seeking other employment opportunities.

• We will hold a meeting in Burslem to address the membership before Christmas.

• In forthcoming negotiations with Royal Mail the Union will be seeking to use the findings of the Employment Tribunal to improve the Bullying and Harassment Procedure. This will help ensure that what happened at Burslem can be avoided in the future.

We all know that the Burslem dispute will become a chapter in the history of the Union. Although we are all disappointed with the outcome of the tribunals, had it not been for the solidarity of the Burslem membership and support from the wider union, then seven of the original members suspended would not have returned to work.

Once again, we wish to place on record our total admiration for the way the Burslem members conducted themselves in the face of adversity. They are and will remain a credit to themselves and the union.

Yours sincerely

but the lads and lasses at Burslem should hold their heads high their fight was just, but the legal system and IMHO Royal Mails internal HR system leaves a bad taste.

Loads of threads on here about it - if you type Burslem in the search facility (top right) you'll see how many - you may be gone for a while though.
