Health & Safety Offences - Now You Know
Health and safety offences do not need proof of cause of death because under HSWA only requires the defendant to have failed to take certain steps to properly control a risk. It is not necessary to prove that death resulted from the risk (although if death was a consequence of a breach then that would be an aggravating factor in any sentencing).
