In Stark v Post Office (2000), a postman was injured when the front wheel of his work bicycle locked. The cause of the brake failure was due to metal fatigue or a manufacturing defect, and would not, therefore, have been evident upon inspection. Nonetheless, the Post Office was found to be liable, as the regulations impose a strict liability concerning the provision and use of work equipment.

While the Royal Mail said recently it is planning to phase out the use of bicycles, it will not remove their duties under the regulation to provide safe equipment for use by employees

In addition, your employer has to ensure that you are adequately trained to use any work equipment and that suitable safety measures are provided.
