If sacked on attendance do you lose right to your pension
This was put to me today. I am on a stage 2 and was resigned to the fact that if i go sick with the same thing again i will be facing the sack at stage 3. If pain returns then im obviously not suited to the job any way but a colleage pointedout to me that if you get the sack you lose your pension. Even on sick grounds. I have been in this job for 15 years. Have a worn disc in my neck compressing nerve and have just come back after a nerve block injection. No pain right now but still reduced grip so a suppose when i return to full hours and delivery in a few weeks it could come back. Next consultant appointment in october. Surely they cant take away my pension if i am sacked.

No... you dont lose your pension if your sacked or you resign . The pension is frozen (increased in line with inflation ) and is paid out when you reach 60/65.... I wouldnt totally resign to the fact that you will lose your job on a stage 3.. All your absences will be gone through and if theres any related ones or the business hasnt done what they should off you should not get sacked...
I would have thought that you would qualify for IHR with lump sum given your long term prognosis.. That would be worth roughly about £15k...Personally, to be on the safe side I would stay on the sick and dont go back...Any Area Rep worth their salt should be able to get that for you...Also get ATOS on board ASAP...

Thanks atos have been rubbish though. They refuse to see me face to face or request my notes. Just keep sending me back (well twice). Doctor printed off consultants report and i took it in myself for manager . Lino said with a smile no you cant appeal against this until stage 3 and makes it clear its not fair on those who have not gone sick so if it plays up again i will go back to gp asap and get him to put me back on light duties until my next appointment.

Thanks noggin, but consultant said if he replaces disc i would be as good as new so told my rep this. Hope i dont need this though as waiting list for it is six months long and there are no light duties. Hate the job now anyway just dont want to lose the pension if they force me out. Thanks all

The condition which covers you under the DDA has lasted or likely to last at least 12 months....

All you need to do, is go to your Doctor, and ask for a report stating that you have Depression, and it's going to affect you long term. As I have previous history of Depression, 2 issues in last ten years and b4 RM employement I presume it will bea easy for me to get covered if I chuck a wobbly again?

A colleague of mine was recently sacked. He had an accident whilst on duty. (completely run over by removal van and trapped underneath) After 7 years of continuing to work, he eventually triggered a stage 3 and was sacked. Appealed but failed to overturn the descision. Obviously I'm not completely up to speed with your case. If you are on delivery, could you walk with light bags? Or better still, use a trolley of some sort? My colleague found this to be a great help, unfortunately too late and lost his job. What I am saying here is this... if you would still have problems doing some other sort of work then try everything you can. If you lost your job, once the truth came out, other companies might see you as a liability and wouldn't touch you with a barge pole. Hope you don't find what I am saying to be offensive, just trying to point out the pitfalls of the early retirement on health grounds. Hope you sort things out ASAP, let us know what happens please.

Yes. But don't wait until then. Go back to your Doctor, and ask him/her to confirm that you're covered by the DDA (because of history of Depression, and liklihood of a relapse), and ask your Manager for a referral to an ATOS Doctor (face to face). The Managers will try anything they can, to find a "get out clause" to avoid making allowances for people covered by the DDA (at least in my experience anyway). Whatever you do though. Don't settle for a telephone consultation, or an appointment with an Occupational Therapist, or anyone else for that matter. Insist on an ATOS Doctor. Once they make recommendations as to how you should be treated, things start to happen.

I'm sure that I read somewhere that if you resign or are sacked RM will claw back their contributions to your pension. You only get to keep your contributions. Our branch secretary believes that to be the case too.No... you dont lose your pension if your sacked or you resign . The pension is frozen (increased in line with inflation ) and is paid out when you reach 60/65
Just spilt stain-remover down my shirt. Now how do I get that out?

What happens to my benefits now that I have left the Plan?
If you were not entitled to a refund of contributions when you left the Plan (and you did not elect to transfer your benefits elsewhere), you will have been granted deferred benefits in the Plan. These will remain in the Plan and will be payable when you reach your Normal Retirement Age.
