I've been trying to find out whats happened to the ERICA report from my AOD in 2009. LM has been through all my paperwork and cannot find a copy. I was never given a copy when the report was filled out. The guy who filled the report in (on his laptop) was one of those Graduates and hes been moved on. LM said today its up to ME to track him down and find out whats happened, surely that can't be right?

Data protection means that only the person who completed the report or the person involved can request a copy.

This means that your current manager can't, but you can.

You'll need to write to the accident management unit with as many details as you can remember and reuqest a copy.

IIRC they're at Wolverhampton, but your manager should be able to give you the full address.

Or you could perhaps ask your CWU ASR for a copy of his or her copy of your ERICA report.

Royal Mail Group have agreed to accept the CWU proposal to add new additional wording that directs Line Managers to notify Area Safety Reps of accidents promptly and to ensure that Safety Representatives are an integral part of accident investigation. The following text has been inserted "Trade Union Safety Representatives are legally entitled to accident records. Managers must notify Safety Representatives of all incidents/accidents and disclose the information in the accident record in so far as it relates to the injured person. All printed copies will have personal information such as home address and telephone number removed. A copy of the Report documentation including name, work location and all other information should be forwarded to the Safety Representative.

I thought I would try and save time for the ASR/Simpson Millar and get the report myself. Too be honest I think the guy who done the ERICA report has cocked up somewhere, because when I had my Stage 3 interview last year the DOM could'nt find the report. On my S3 deliberation notes there is no mention of the ERICA being lost but it does say 'No evidence of the AOD being fully investigated'

contact the HSE and DWp And report you AOD as you have three years to report an accident also contact your Area safety rep and fill in an LS3

Already done belle. DWP has classed my AOD as Industrial Accident. Filled the LS3 form in and Simpson & Millar are on the case. Its been a year since I done all the paper work and it seems that finally things are progressing. I'm finally getting to see a Orthopaedic & Trauma Consultant next week after having Physio on and off for the past year. The strain of having to work through my injury has also affected my other leg now.....over compensating I guess.

I think your best bet, would be to contact the Manager who filled in the ERICA, and request a copy. If he/she can't/won't provide you with a copy, then try getting your H&S Rep involved. It sounds like he/she might not have filled it in properly. Otherwise, it would be a simple job for him/her to pull it up on the Computer.

On re reading sister Stormproof's posting it is the first time that I have ever known an ERICA report to be filled out on a laptop normally always done on delivery office or site office main computer.

With regards also to completion of ERICA Reports the following should also be noted:

The box headed "Paperwork Compliance" has been amended to read "(i) Print out two copies. (ii) Store one in ERICA Folder. (iii) You must immediately send a copy of the incident report to the Union Safety Representative in good time."

Local Records - CWU raised concerns regarding the need to retain local records for inspection, audit, compliance and enforcement purposes.

RESOLVED - A locally retained "ERICA Record Book" will be maintained on every site. This will consist of a sectioned Ring Binder in which Managers will file the various incidents by type in each section and the book will be subject to Audit and Inspection by Trade Union Safety Representatives, auditors or HSE/LA Inspectors.

Perhaps it would be beneficial if sister Stormproof asked her manager to look in this folder for her 2009 AOD report or there again sought assistance from her CWU ASR and enquired of them to use their audit and inspection powers as described above.

For clarification purposes ERICA Handbook - An "ERICA Handbook" has been constructed which will be issued to all managers and offices (talking 2006 here).

Something just doesn't sit right with a graduate allegedly completing an ERICA report on a laptop. I am not doubting the veracity and truth of sister Stormproof's statement but she may have been led to believe by this graduate that this was the correct procedure to follow with an AOD but I have a hunch something is amiss. Examine the given facts:

It's not unusual for them to use laptops now (at least at my site), because we've got a wireless network. So it's really no different to using the desktops in the offices. It just depends on whether there's an empty room with a desktop available at the time, or not.

Fair do's then bro but are these laptops connected via a wireless network also hooked up to a printer. Remember two copies printed off (one to be retained in the ERICA Folder and one sent to the CWU Safety Representative (ASR)).

Just had to do another ERICA after the cat attack yesterday (yes I've heard all the cat jokes today! :arrrghhh ). Acting LM filled it in.......got there eventually :roll: and I made sure I saw the copy in black & white and signed it this time.

:sad: Actually, they are referring as the time in which you can report an accident at work to the D.W.P--they have allowed claims going back eight years. AnyAccident at work should be reported to them by you.

They use the Network printer in the Manager's office to print it up, collect the printout, and bring it back to us. That's the trouble with these open-plan offices for the Managers. There's often more than one of them in there at once, so there's no privacy. Which is why they started using the laptops in the first place. There's usually a room empty, even if it's the "Team Learn" room.

The three year limit, is for putting in compensation claims. Like you said, DWP have been known to accept accident reports in excess of 3 years after they've happened.
