Smoking in vans

We have no designated smoking area at our office and the manager over looks
smoking in vans, on the loading bay, under the bike shelters,
As i am a driver and have to use the vans, it absolutely repulsers me to get in
to a van that has been smoked in, the loading bay too, loading the van and breathing in second hand smoke
makes me want to throw up,

SMOKEFREE VEHICLES

The new law will require vehicles to be smokefree at all times if they are used:

to transport members of the public

in the course of paid or voluntary work by more than one person – regardless of whether they are in the vehicle at the same time.

Smokefree vehicles will need to display a nosmoking sign in each compartment of the vehicle in which people can be carried. This must show the international nosmoking symbol no smaller than 70mm in diameter

When carrying persons, smokefree vehicles with a roof that can be stowed or removed will not be required to be smokefree when the roof is completely removed or stowed.

Vehicles that are used primarily for private purposes will not be required to be smokefree.

Initially you should approach your manager with your health and safety concerns but as he or she apparently frequently overlooks the fact that employees are breaking the law by turning the proverbial blind-eye to their transgressions, then realistically they will continue to do nothing about it despite your protestations. 2nd port of call is either to your CWU unit/workplace health and safety representative if one isn't in situ then it's the CWU Area health and safety representative.

Failing all else:

Then take direct action report your manager stating your daily observations to your (Smoke Control Environment Supervisor) who should be located at your local Environmental Health Office Headquarters and ask them what they would advise to make your manager comply with the law. And if necessary take pictures.

You could also have a word with your local council as

Managers who knowingly fail to prevent smoking in a smoke-free vehicle will face a £2500 fine. Local authorities will enforce the law.

drop a note to your DOM that you are going to contact the local environmental health officer, usually at your local council, this should do the trick.
