RE: Royal Mail and Logistics Conduct Codes

Royal Mail have informed us that as from Monday 6th April 2009 a change will be made to the Mail and Logistics Conduct Codes.

From this date following the fact finding meeting, the case must be passed to the individuals second Line Manager if there is the possibility of a major offence/dismissal penalty being given and the option of a Manager who is EL1 (or equivalent) conducting the whole Conduct Code case has been removed.

Paragraph 10 – Processing Cases has been amended therefore to read as follows:


“Where dismissal or action short of dismissal may be an outcome, the fact finding should be carried out by a Manager other than the Manager who will make the decision in the case.”

This change has come about as a result of the introduction of a new ACAS Code of Practice on Disciplinary and Grievance procedures, and is seen as a positive and fair change to the existing Code. Royal Mail have published some advice regarding precautionary suspension. Whilst this advice is for Managers, the Union has not agreed this wording and is subject to further discussion.

Branches should be aware that the business have also proposed a number of other changes they wish to make to the Conduct Code.

These proposals are currently being discussed by the Union’s Conduct and Attendance Group, and have not been agreed.

We will, of course, keep Branches updated on any progress with these proposals.
