Hi all
I may be wrong but I’m sure that if you’ve been on a duty for 12 months and it’s hasn’t been to cover long term sick or any other planned reason then after 12 months that person can claim the duty. I’ve had a look but can’t find the relevant agreement, any help would be appreciated

How long had it been vacant before you started on it?

It’s not me and I’m pretty sure both an area rep told me and management about a few years back. Also, recall it applying to do if you were regularly working x amount of hours as covering a duty for that time period then you can lay claim

All vacant duties should be up for picking when 5% of the duties in an office are vacant or 6 months after the last time all vacant duties were advertised, whichever is sooner. So in theory you shouldn’t be on a vacant duty for 12 months unless it’s a duty no one wants to apply for when it’s been advertised. In practice I would guess this doesn’t actually happen in most offices, certainly doesn’t in mine.

14.4 Where a full-time post is advertised internally, it will be available to all full-time employees and part-time employees, who have opted for full-time employment, in that resourcing unit. The posts will be filled on the basis of ‘most senior individual’. Where a part-time post is advertised internally, it will be available to all employees as above and filled in the same way.
14.5 The resulting vacancy will be temporarily filled by a reserve, a surplus employee, a transferee from within the wider resourcing area or another resourcing area or by direct recruitment in line with the process above.
14.6 When the number of consequential vacancies in the resourcing unit reaches 5%, or after a period of six months following the last such exercise (if earlier), the posts will be advertised in the resourcing unit, en bloc and filled on the basis of seniority. If this results in any further vacancies, these will be filled, using the same process as above.
