Regarding stage 3 dismissal
I’ve been a postman for 5 years now and was off last year for 7 months due to mental health.
I’ve since been off again a number of times after this being mentally and physically unwell which has triggered a dismissal stage 3.
I come under the disability act, but there’s nothing for me to do within the office as of light duties to meet my needs.
I won’t be returning, and my boss is aware of this.
I’ve had numerous OH appointments for adjustments but there’s nothing there for me to do.
My boss has told me to resign, but that’s not what I want to do as I don’t mind the job. I’ve told him that I would like to be dismissed and in writing that I’m not fit to work mentally and physically.
I was wondering if anyone knows if I would be eligible for any payout. I don’t think I am, but I wanted to check with anyone on here who may know.
I don’t think I would be fit the criteria to be medically retired, because I don’t pay into any pensions.
Would anyone know if there’s anything I could possibly claim in the process due to my circumstances?

We had a colleague with a similar story.
He has now left the business. The rumour is he was given Ill Health Retirement.

Speak to your Area Rep about it.
If you can't do the job due to having a disability and they won't put you on light duties or give you alternative work, then they need to dismiss you in writing because of your disability. You don't go into work if they are not prepared to accommodate you. I would also download payslips and your P60 from the app before you get signed out of it and keep all paperwork regarding your mental health. As for getting IHR I believe it got significantly reduced as a result of the last pay deal but it's worth holding out for it though. A friend of mine had to wait months for a payout regarding IHR mainly because the DOM at the time kept ignoring it, but you need to keep on at them by sending them letters and ringing them up.
Regarding pensions, I'm no expert, but having done some digging I believe they should give you two options - A decision to progress 'retirement on ill health grounds with lump sum payment' OR a decision to progress 'retirement on ill health grounds with immediate pension'. Obviously, any confirmation will include the proposed last day of service and a summary of the reasons and basis for the decision. You also have the right to appeal against their decision.

There seems to be a massive stigma surrounding mental health and many people view it as people being lazy, lacking willpower or that they choose to feel that way. We all know as employees of RM that our job can often be physically and mentally taxing and the OP still wants to work but the business are trying to rub their hands of him by refusing to make any reasonable adjustments in relation to his disability. The company wants him to resign and leave voluntarily so they don't have to deal with it. This is wrong and there is no reason why the OP should not hold out for money especially if he is prepared to work and is struggling with his own finances.
On the face of it, shareholder value is the dumbest idea in the world.

What a sympathetic character you are. Why would the OP knowingly make his/her life more difficult financially when they are already struggling mentally and physically? We need to end this stigma that people with mental health issues are after money or lazy. Posts like yours could push people over the edge and are wholly inappropriate.
OP - get in touch with your union rep. They are the only people that can help you unless you employ external legal experts. I wish you well for the future whatever the outcome.

You can’t ’play a mental health card’. Doctors recognise legitimate mental health issues and those that are not. The only way you can play the system is to get time off work, but that is why the sick policy was changed, because too many people were taking the piss. You are not going to be paid to leave RM without being properly diagnosed as the OP clearly has.
This whole mental health stigma is an invention by the media, and is just the newest in a long line of attempts to scapegoat people with legitimate grievances - see also benefit claimants, asylum seekers, immigrants etc etc. It is a rotating cycle of which mental health suffers have now found themselves a part of.

they are trying to get you gone free and easy, facts are under the disability act they more than likely have to pay you off to leave via IHR, please seek union advice

Well you can play the mental health card. To suggest otherwise is daft. There's three at our place who happily boast to having months off every year from simply claiming work related anxiety and stress. People who game the system, inevitably know how to play the system. That's why people get so frustrated with it, because if you're not regularly in the system you don't know how it works and you inevitably get screwed over as a result. Then governments and companies penalise everybody, because of the actions of a minority. I'll echo that, there's been two at our place who wanted out and played the game, 6 months full pay then got ihr, admitted to their mates nothing wrong with them so they somehow managed to get doctors to sign them off, imho the changes to sick pay are seriously flawed, they "punish" people like me and plenty of others who might need to take an odd day off with the sh***s etc but the folk who take the piss on long term sick are laughing their tits off.Seymour Buts wrote: ↑15 Aug 2024, 16:35Well you can play the mental health card. We've currently got another doing the same thing (no I'm not just saying that with no evidence whatsoever their wife has confirmed it to someone whilst pissed up)
