Say I came back from sickness, said I am feeling better but still have some mild symptoms.... if those symptoms are deemed too dangerous for you to carry out your duties I assume it's up to the manager to send you home.... is this correct?

If a manager sends you home does that mean you get a full days pay instead of the £20 statutory sick pay? (if the day off is on one of the designated unpaid days).

I assume 'back to work meetings' should be done the morning the employee is back at work - this rarely happens at our place. So I'd assume the manager would be partly responsible if the employee has an accident as a result of still suffering from their illness/injury and they hadn't done the back to work meeting.

Not sure about the financial side, but one of the main reasons of the back to work interview (apart from them offering concern and sympathy after your illness :left: ) is to assess that you are fit to work, or what help/adjustments you need to support your return. So in that respect the manager is very much in the frame if it was obvious that you weren't fit for work and had an accident. eg doped up to the eyeballs on meds and zombified. Would be hard to prove though i guess unless witnesses or other staff telling manager you were too ill before the accident.

Yes, you should have a welcome back meeting as soon as possible but legally every employee has a responsibility for their health and safety and that of others , this would include informing your manager of a reason why you couldn’t do your job safely. The onus is not solely on the manager so don’t expect to apportion blame you could find yourself being conducted instead for failure to inform them!

Were you well enough to return to work or not?
If not, why did you return?
Why are you trying to blame a manager. :crazy:
