Phased return agreement has been broken, could do with advice

Hi all,

After 14 months off due to a serious injury, that left bones broken in several places, months on morphine, a long and slow semi-recovery and being left with permeant disability in certain areas, a phased return plan was made involving small amounts gentle of outdoor work and some throwing in d2ds, on Monday I was given a workload which I didn't know for sure, but had a feeling would be too much, involving flats overpacked bags and huge bundles. It was far too much, and has left me in pain and really annoyed. After some time I simply said to myself, 'enough is enough' and with a volume of work remaining that would have pushed me 2 hours over my agreed time I returned everything to the office.

They have broken what they agreed already in terms of my return plan, and I fear this will continue. Our union rep is off this week, where do I stand with this. Can I refuse to do it? Because I simply cannot. I'm also struggling to drive and was forced to use a van.

If your rep isnt in this week take it to the area rep. Document everything you are told to do and what is said. Tell your manager that they are giving you too much to handle and follow the cut off procedure just the same.

I hope you’re seeking legal redress for these injuries and have photographic evidence that the hazards are still there. “ Safety is our number one priority “ , just remember that when you’re wincing in pain.

I'm documenting everything. Regular photos of the mess still strewn in the yard and sometimes in the office. After repeatedly expressing to them that the work they pushed on me has worsened the symptoms of my injury they have, for now, backed off and given me a more manageable workload.

I will be perusing a claim soon, I wanted to wait until the extend of my permeant injuries became apparent and to document my phased return (knowing it would not be adhered to). Just about now I feel I have all the information I need to begin a claim with a privately appointed solicitor (not the CWUs ones). I was worried if I started the claim too early, a greedy solicitor would just push through a claim for a quick payday, that didn't reflect the life-long issues I will now have to live with and the permeant affect it will have on any future jobs I go for, I've done courier type work for the last 10 years but I will not be able to take another job with such physical demands. I've already had to drop several life-long hobbies, pain is now a daily part of my life, financial uncertainty, stress etc.... My future has been impacted quite badly, crazy they've still not sorted out the issues of junk that's been in the yard for several years, and I'm talking piles of old trollies, bikes, old heaters, fans, office equipment, bread baskets, boxes, hundred of bottles, bags, broken yorks, sweet wrappers, and leaves this time of year, and a LOT of other junk. Only a matter of time before someone else is hurt (areas the public use are also very bad), hopefully a financial hit will motivate them to take things seriously and prevent anyone else suffering what I have, or worse.
