Absolutely disgraceful agreement, it was put to a branch vote, ours was done over about 3 days on Facebook which has about 20 members in.

Since RM failed to pay me my average pay in 2022 I simply stopped doing overtime. Next week is my 1 year no overtime anniversary, it’s not been easy at times (I’m on a 28 hour contract) but I feel better for it and don’t need to worry about getting those 8 hours in.

I feel sorry for those of you who have missed out and hope you manage to get the money through the correct channels.
The day is gonna come when we’re all gonna have to testify.

I believe we both had a discussion over in the average holiday pay section - it’s too late for me to put in a claim again but I hope others do.

I would advise anyone going down the ACAS route to seek some proper legal advice rather than the opinions of random posters.

The Holiday Pay Agreement is now an established part of your terms and conditions as agreed through collective bargaining by your recognised trade union.

It is part of your contract. That's usually where an employment tribunal washes its hands.

The thing i can't get my head around, is why the union agreed a deal that can screw people over and get zero holiday pay, when they work loads of overtime all year round, except for one month.
It may be too much hassle to try and claim, and don't want to get in trouble with RM if I take them to task on this. But like I said there's no way someone like myself who works 50-65 hours a week, should get nothing on my 3 week holiday, just because I had a month where I claimed 6 hours. It was the strikes that did it. I had a feeling that would bite me in the ass. Won't be doing it again, that's for sure.

One of the worse rules the union have voted in. I’ve been here 38years and nothing compares with its unfairness. It makes you wonder if there was some dark forces at work somewhere along the line.

s**t show again from our union. Didn't even give us a vote on it. It went to a branch ballot. How very democratic. Have work colleagues out with bereavement. Then come back to work and miss out on holiday pay. Disgraceful.

Can we still go the ACAS route?
Im not a legal expert.

Woodie has replied to seek proper legal advice before going to acas. His experience is better than mine. I just cant believe how the cwu managed to snatch defeat from the jaws of victory.

My laymans understanding is RM cant not pay Average Holiday Pay when the law says they have to, even though RM have an collectively bargained agreement. To me its like the Tories saying the min wage is £12per hour but the cwu's collective bargaining power gets us £11 per hour.

I think the cwu are clueless but i believe we must all stick with the union otherwise it will get a worse & faster.

With the current dispute i'm not voting NO & cant see how we can win. Royal Mail hold all the cards. With Pay Holiday we held all the cards and the union folded.

I have now won 4 cases against Royal Mail in spite of your ridiculous agreement, 2 were settled by payment and 2 were given a court ordered judgment in my favour. Stop scare mongering, people are losing enormous sums of money as a direct result of Union incompetence.

The Union and RM do not, contrary to their beliefs, decide what the law is.

All you have to do is follow the ACAS procedure, it is not difficult but can be time consuming, and so long as you remain courteous and professional then you have nothing to worry about.

Same happened to me, 30 hr contract but consistently put in 45-55 hour weeks, then a months overtime ban wrecked my holiday pay.

this is a joke. How is it your fault when there's a overtime ban. You've been busting your ass all year, and get nothing for something outside of your control.

Summer is a light period, so wouldn't be surprised if OT dries up for everyone. They've done this on purpose so they can screw people over and not have to pay them anything.

I'm starting to resent the union for agreeing this. I could have easily had 300-400 for my 3 weeks I had off, but because of the strike didn't get any. I'm going to contact the union. But probably would be better trying ACAS as been suggested.
