Anyone done Jury Service. Need advise on wage claim.

I'm on Jury service in a couple of weeks. Royal Mail will pay me but will treat it as a loan as I need to claim back from the courts. RM will ask for this money back

I phoned the courts today (took an hour to get through) and they said I need to give my boss a " loss of earnings" form who will then fill it out and send it off to HR? The only form I have been sent is a "loss of earnings form ONLY if the employer isn't paying you",. which they are!!. So is that the form I need to give to my manager?

All this is supposed to be filled in and sent off to HR before I do the jury service so I'm getting a bit confused as to what form RM are supposed to have?

You hand the form for the employer to your manager to get stamped.
You'll need to give it to the court on your first day.
Royal Mail pay you as normal.
You then claim back the expenses from the court.
Royal Mail will ask for those expenses back*

Days you're called, you attend, days you're not you work as normal.
If you've attended or worked Monday to Friday you get Saturday off.

I suppose technically the employer (RM) won't be paying you as they will be claiming it back off you ...

The only form I can find is the claim form if your employer isn't paying you! Is that the one my manager needs??

Yes I did jury service about 5 or 6 years ago.

What happened then is possibly different to today, as a colleague did jury service a few weeks ago.

I warned him of the difference in pay - but he did not report any wages problems.

RM do indeed pay your wages (as a loan).
Then when your jury service is finished they pay you but its not as much, so there is a difference to pay back to RM.

Jury service can also depend on length, 2 weeks or if required (12 weeks I think).

A helpful chap at RM Sheffield wages navigated me through the wages process, but I can't remember his name - Geoff possibly ?

Any way, good luck and try to enjoy it, but take a good book with you.

By the way you get lunch expenses every day for a sandwich etc.

That’s the form your Manager needs. He should fill it in and send it to H.R.
H.R. then fill in their part of the form and should send it back to you to take to the court.

I got a letter in for potential dury service, on the letter it explained what website to go to to download the relevent forms for my employer. I printed them off and gave them to my manager. He told me RM would pay me and i didnt need to claim through the courts service. In the end i didn't get selected for dury service but was told i didn't need to claim loss of earnings if selected

I did jury service in october last year, the loss of earnings form was for people who do regular schedule attendance/overtime as i do not do any overtime i did not need this form, Royal mail paid me my wages as normal with no issues

I was on jury duty as well , Royal mail paid my wages as a loan , I claimed them back from the court and repaid Royal Mail, just because a manager tells you something it doesn't mean they are correct, always double check with HR if in doubt .

But this proves how stupid managers can be, ripping duties out on the one hand to save money as RM (a private company)
is apparently losing money hand over fist but RM end up paying for an involuntary/compulsory requirement
from the Govt. which (after all the paperwork faff) can be paid for out of Govt. (taxpayers) pockets.
But because the manager probably can't be arsed with the paperwork and/or doesn't know the rules, RM ended up losing money!

You're correct in saying that SA can be claimed back under the allowances clause:

If you pay your employee
If you carry on paying your employee, work out the tax and National Insurance contributions in the normal way.

You can’t claim back money you’ve paid the employee or that the business has lost during the jury service.

If you don’t pay your employee
If you don’t pay your employee, they can claim a loss of earnings allowance from the court.

You’ll need to fill in a certificate of loss of earnings for your employee. They’ll get one with their jury service letter.

If their jury service lasts longer than 3 months, put ‘Yes’ in the ‘Irregular payment pattern indicator’ field in your Full Payment Submission (FPS).

If you top up their allowance
You may decide to top up your employee’s allowance so they don’t lose out on pay.

You’ll need to fill in a certificate of loss of earnings for your employee. They’ll get one with their jury service letter.

To work out the top-up payment, subtract the court allowance from your employee’s usual take-home pay. This will give you the amount you need to give your employee.

jury service is fairly easy to get out of, just make up an excuse. Friend of mine went to a doctor and said hes been having insomnia and wouldnt be fit for jury duty and signed him off. Doctors can sign you off for a number of things. You could always say you biased towards certain cases aswell in court or prejudiced. I would go the doctors appointment route tbh,covid is also an excellent excuse. i would never waste my time doing that pointless crock of s**t

That's may have been a thing back in the 1950s, but it hardly passes muster now.

When did we, as British citizens, sign up for compulsory jury service?

I don't believe the state should force an individual to perform jury service. Everyone should have a right of refusal.

There are people (retirees,, unemployed etc.) that love doing that sort of thing, so perhaps there should be an opt-in, a bit like organ donation.

Everyone should have a choice. That is a basic human right.

Just remember that should you be unfortunate enough to have something happen to you which results in the offender ending up before a jury, you may be very grateful for their involvement.

Why is it with a minority of people that everything should be done by someone else? They're always big enough to gob off about everything but when it comes to actually doing something, that's then down to others.

I did JS a few years ago and it was a nice change - MON-FRI for 3 weeks, no early mornings, full pay, and I would do it again no hesitation.

Jury service is not optional and is bound into UK law.

If you ignore or fail to respond to a Jury Summons from the Bureau, then you could be fined or worse.

There are genuine reasons for not attending, such as serious illness or disability or full time carer etc.
