just had me mate on the phone, he mentioned our gaffer has said the later start times are coming in at ours in the new year whether we like it or not and it will be 8.45 for F/Ts 10.15 for P/Ts. can we just refuse? i mean we are striking for 'change' as well as pay. i said they won't be able to do it if we all refuse and just come in at our normal time, and he reckons we might all be suspended without pay if we do. and up to now there's been no guidance off the union.....any thoughts? its going to be a shitstorm in there in Jan.

Sounds likely. Dave Ward has just said on youtube that they have plans for when Executive Action comes in - it's like he knows it's imminent.

You cannot be suspended without pay but?

You will be suspended for failure to follow a managers reasonable instruction or even dismissed for abandonment of duty.
Royal Mail is who you have a contract with, not the CWU.

If they are forcing that change in they might as well start paying us the 9%.

a 4.15pm finish doesn't sound that bad to be honest. I was concerned I'd be going home in rush hour. I thought it might be a 6pm finish.

Still doesn't make sense to me - delivering in the dark and during school rush hour.

Don't mind these times if we can stick to our finish times... Not staying out til 5 in January.

28 days notice required by law I think

In all honesty by now everybody should be doing the job correctly anyway and without the staff onboard their plans are doomed.

They can change your contract just by giving you the legally required amount of notice, is it 28 days ? We are striking as they want to change our terms and conditions, ie contracts.

Making a change without agreement
If an employer makes a change to a contract without getting agreement (including by using flexibility clauses unreasonably), employees may:

have the right to refuse to work under the new conditions
say that they’re working any new terms under protest, and are treating the change as a breach of contract
resign and claim constructive dismissal
be able to take a case to an employment tribunal

Exactly what prescribed contractual terms are Royal Mail breaching to justify a 28 day notice period?
