CWU member compensated for work-related back injury

Simpson Millar was asked by the CWU to act for one of its members after her back was injured while she was on her rounds.



In May 2010, a postal worker was performing routine deliveries to Maplestead Avenue, a residential area in Wilford, near Nottingham.

On reaching one of the houses, she sustained a back injury when a step up to the front door letterbox crumbled. She was required to undertake a course of physiotherapy for the injury to her back. The injury and subsequent therapy forced her to take 7 days off work.

The postal worker's union, the CWU, instructed us to take action against the householders for recovery of compensation.

Our case was founded on the premise that the householders had not provided a reasonably safe passage to and from their property in accordance with the Occupiers' Liability Act: a courtesy she had every right to expect as a lawful visitor to the house.

The defendants also failed to ensure they had an inspection system which could have brought to their attention that the steps were likely to crumble.

All allegations were accepted by the defendants, who in due course agreed a settlement of £2,500.
