fall at work / my responsibilty to fill in erica form ?

Hi all,
I recently had afall at work, wearing standard issued magnums. I had the accident on the friday, after returning to the office
To be greeted by no managers I left a message with phg. Saturday morning comes and phone in sick, manager hasnt been told and still wants me to come in to complete forms. Correct me if im wrong, shouldn't there have been a manager present when I got back to the office and forms filled in at this time?

Any thoughts would be greatly appreciated

my personal view on this issue is there should be a manager in the office untill all posties are back, but we all know this never happens , postie could be upside down in a ditch on a saturday and if he lived alone as i do wouldnt be missed till monday morning when the manager phones to ask why you have not turned up for your monday morning duty. by which time you could be dead.

All our line managers have usually gone home well before 2 (well they get there at 6:30 sometimes so they only work to their time) but there is always the underdom who works 8 til 4 (exactly). I know , they're disgusting giving us orders to work until we've finished. Luckily after my fall on the ice , my lm was still in the office, he filled in the erica and we both left at 2:15 , i'm pretty sure he claimed 15 minutes overtime for that!

In our office.....many times there isn't a manager around for hours on end for one reason or another (and we have at least 4 every day in charge)...so we are told to leave a mesage on their answer phones if an accident occurs as soon as possible.

1. The accident book or equivalent must be readily accessible.

2. It is a matter for the employee, not the employer or any one acting on behalf of the employer, whether an entry is made in the accident book or equivalent.

3. There is no restriction on the nature and type of accident and injury that can be entered into an accident book or equivalent. With reference to paragraph 2 we would specifically assert that it is for the employee to determine whether or not they have sustained a personal injury and whether they have been involved in accident.

4. There is no restriction on the time within which an accident has to have occurred in order for an employee to make a record in the accident book or equivalent. Regulation 25(3)(b) implicitly recognises that an entry may be made in an accident at some point after the accident occurred.

ERICA's must be filled in within 24 hours of the accident or incident

so I would say regardless of the right or wrong's of there being a manager when you got back it was probably in your own best interests to go in on the sat and fill it in should you ever need to rely on it in the future

the point about no manager being present when you returned could and should be highlighted in your return to work

That's a Royal Mail driven/made up thing designed solely to reduce the number of reported accidents..
It has no basis in law and refusing to allow a member to fill in an ERICA after 24 hrs is a clear breach of regulation 25(3) of the Social Security (Claims and Payments) Regulations 1979 (as amended).
