Swiss Post Ignores Settlement; RPost Files New Patent Infringement Suit against Swiss Post

RPost®, the Registered Email® company, sued Swiss Post in 2010 for patent and trademark infringement. The parties settled under confidential terms. Swiss Post has ignored key provisions of the settlement, forcing RPost to file a new lawsuit and to once again use the court system to enforce RPost’s patent rights. RPost has asked the US Federal Court to issue an injunction against Swiss Post to prevent further damages.

“We do not understand why the Swiss Government would jeopardize their reputation and image by allowing its executives to operate in this manner,” remarks Zafar Khan, CEO of RPost. “Swiss Post executives’ have no excuse for this blatant infringement of RPost patents.”

RPost’s flagship Registered Email® service has provided senders legally valid, court admissible evidence of email content and delivery since its first US Federal Government customers started using the service commercially in 2003.

A patent right is essentially a contract that an inventor strikes with a government -- the inventor agrees to teach others how to practice the invention in exchange for the government’s grant of exclusive rights to that invention for a period of time. Swiss Post has taken RPost’s teachings while ignoring the government’s grant of exclusive rights to RPost technology. RPost has asked the government to now enforce the rights it granted RPost when issuing the patents.

“Swiss Post appears to believe they are above the law -- displaying a total disregard for the intellectual property rights of others. Unfortunately, Swiss Post’s actions put their users, partners and other postal services considering Swiss Post technology at considerable risk,” Khan says. “A word of caution to users and partners of Swiss Post services; we intend to vigorously defend all of our intellectual property, everywhere.”
