LTB 826/11 - Default Retirement Age
LTBs 140/11, 297/11 and 368/11 set out communications in relation to changes to Royal Mail’s retirement process following the government’s decision to abolish the default retirement age of 65. The following changes will take effect for employees who turn 65 on or after the 1st October 2011:
Employees who turn 65 on or after the 1st October 2011 will not be subject to compulsory retirement under the duty to consider process or any other procedure - this means that employees can continue working beyond their 65th birthday as usual.
Employees who wish to stop work when they reach the age of 65 or anytime after will need to resign from their employment in the usual way (by providing written notice in accordance with the notice periods set out in the individual employment contracts)
The points detailed above do not apply to any employees who have already received the notification of intended retirement under the duty to consider process. Furthermore these changes do not impact individual employees entitlements under the Royal Mail Pension Plan.
An initial meeting has been held with Royal Mail Group regarding changes in legislation and in particular reviewing the existing age cap 64.5 for accessing voluntary redundancy within MTSF. This will be relevant to those employees who are due to turn 65 on or after 1st October 2011 and have not already received a notification of retirement. Royal Mail Group have advised us that they are still considering the impact of the change in legislation on the application of the voluntary redundancy/severance terms to those approaching and over 65. Discussions are ongoing and a further meeting is in the process of being arranged. Once discussions have concluded we will be in a position to provide all affected individuals with details of the approach agreed with the CWU.
