A/L while off sick

If you are off sick with long covid, and the sickness period encompasses two weeks of pre booked annual leave , should you get the two weeks back on your return to work ? Anyone know ? Thanks

Thanks WG. Your reply , however ,indicates there may be a longer answer. Would there be any obvious exceptions to this rule ; Domcom is suggesting that because the sicknes period is long covid I may not be entitled to get the weeks back.

You are either on sick leave or on annual leave - it can't be both.
If you were on sick leave you didn't take your annual leave and consequently it is outstanding.

The only problem being if you didn't tell them you were still sick.
If the climate was a bank, they would already have saved it.

First of all long covid is an illness like any other so it makes no difference.

Secondly as Clash points out you really should inform management but if you were in regular contact during your illness that would suffice.

Your manager cannot move you from sick absence to annual leave without your consent so there's no reason why you wouldn't get your holiday back.


From the attendance agreement...
20. If an employee is on sick absence and they are due to go on holiday what do they need to do?

If an employee is unable to take holiday due to being unwell they should notify their manager at the first opportunity and the sick absence should be recorded as continuous.

If annual holiday follows a period of sick absence and the employee is now able to return to work the employee should inform their manager that they are fit to return to work, however they are resuming onto annual holiday. The manager would then close the absence on PSP.

The best thing to do is look at the dates for the sick absence, if it runs continously through the entire period then obviously you can't also have been on annual leave.

Yes uninterrupted sick leave and authorised by dr’s certificates ; so thanks I will rebut any attempts to deny me the opportunity to rebook the A/L.

grey area if you actually go on holiday in the middle of sickness, both my dom & area rep said I'd still have to use my leave booked and went abroad even if all booked ages back

As long as you have a fit note covering illness you will be credited annual leave.

That is correct. It will be still classed as one sickness when u come back if u went back on sick,but all partys must be informed.This is law check the ACAS, Web site. If u had a health issue which effected work, body or mind .Doesn't stopp u going on holidays
