thats a load of Bullsh*t... if its a special delivery there is no way that royal mail dont knwo where it is...
im speaking from experience...
i ordered something from a reputible online site... paid a chunk extra ££ for next day special delivery.... only for it not to arrive 3 days later (was shipped on the tuesday)
the "public" online track and trace gave the normal "progressing though our network" response...
i asked the PHG if they could check on the Intranet thingy if it was a different track and trace system... they checked the tracking number and it showed that the item was sitting in a depot (not a mail centre) around glasgow... the screen that the PHG showed me listed every action in the process ie. collected, accepted at X office, sorted at X Office, etc ... and showed the time and date of each scan...
so either the item has been scanned when RM collected it, and then got lost into "normal" mail... or its been misplaced, missorted, damaged, or address details missing/damaged blah blah blah...
but there is no way that i would believe that they dont know where it is... they must know where/when it was collected and if its scanned into a depot/mail centre etc... thats why people pay a god damn fortune for special delivery over the "£1 odds for a sticky label with no actual tracking and often no proof of delivery and/or EPOD" recorded delivery

There is no system anywhere in the world that is 100% accurate so it is entirely reasonable that it is lost in the system somewhere. Is there more than reasonable evidence that the item has been stolen rather than misplaced, damaged or destroyed - Not really - therefore would be the police be willing to investigate as a potential crime, and would tax payers accept use of limited resources for such an investigation. I think that's the main thrust of this thread, and unless we have any criminal lawyers out there then I don't think we will ever get a definitive statement either way.

if its a special and its been sent out and a tracking number was received and it hasnt been delivered surely the royal mail would have paid out compensation to the financial institution

The only thing that should matter here to the original OP is getting their money back. Which as previously stated should be from the Sender as this is where the contract lies. Sender then claims from RM. Due to the nature of this special delivery, I would imagine RM will investigate this fully. It's really not up to the OP to inform the police, but up to RM to handle it itself.
The distance selling regulations state that the onus is on the sender to prove delivery for things like this. Not just to prove it's been posted, but to prove it's been delivered
