Manpower TUPE

Is there anyone on here that was TUPE'd over and had their rate of pay reduced, breaks deducted and pension contributions stopped. Basically treated as a new starter.

One of our Manpower casuals - a long-timer of 3+ years — said in August/September (whenever we stopped using Manpowr) that this was happening to him and that he wouldn’t be coming back as a result. However, he very quickly reappeared as an Angard casual and said it had been a standard email sent in error, that in actual fact he had been “migrated” to Angard with his “qualifying period” rights and entitlements, including hourly pay, pension etc, intact — in short, with no change.

As such, might be worth speaking to someone at Angard to clarify…

I've got my pay rate reinstated but they haven't sorted out my pension contributions for the 1st 12 weeks and they are still deducting breaks. Angard know they haven't followed TUPE but they are only resolving the issue if people complain.
I would advise that your colleague double checks the break situation as another casual thought his paid breaks had been reinstated and it turned out they hadn't been so now it's the endless chasing to get the money paid

zacattack, where in the UK are you based? My team suddenly lost their paid breaks with zero communication from Angard. We also did not get the seasonal rate backdated. A manager at Angard has told my colleague that the Royal Mail higher management asked for this to be the case for Scotland, apparently because they wanted to save some money! This might not be true but it's the only communication we've had from Angard because they never reply to emails or complaints.

I'm down sarf. If you were with Manpower previously and did not get your breaks deducted then you shouldn't with Angard. If you started with Angard before the strikes then you are entitled to the same Terms and Conditions as an permanent employee would get if they also started on that date. If you're in Scotland then I've no idea if employment law is different regarding agency staff

I have about 4 years service as agency for RM. Originally with BlueArrow then got the forced move to Angard about 14 months ago. Conditions were exactly the same (hourly rate and paid breaks) up until about 3 weeks ago when they gave us the seasonal hourly rate but at the same time deducted an hours wage per shift. So, we've seen no benefit from the enhanced rate. If we continue to get an hour deducted from pay when the rate drops back down I'll just be packing the job in.

You should be getting paid breaks as your start date was before Oct 2022.
A less cynical person that me would think it's a mistake but as my emails are being ignored, I can only assume it's a deliberate, flagrant breach of employment law.
I've reported Angard to the Employment Agency Standards Inspectorate.
I'm so done with chasing what I am legally entitled to.
