Injury on way to work


Hello all,

I was on a stage 3 for attendance (DDA diabetes & depression) & had a dismissal interview. I was taken off stage 3 but was told if I had two absences of 4 days or one absence of 10 days or more they would restart dismissal proceedings. I have since had an accident on my way to work - a slip on a wet path & fall. I was taken to hospital by ambulance and was diagnosed to have a T12 fracture of the spine. My DOM said I should return to work, which I did after an absence of 3 work days. The next day I had an appointment at the fracture clinic where they said there was no way that I should have returned to work. They said I should refrain from work for at least 8 weeks & gave a sick note accordingly.

I am obviously now fearful of dismissal.

Can anyone advise me of my position & likelihood of dismissal?

Am I entitled to compensation for the permanent damage to my spine?

P.S. My slip & fall was caused by new CAT trainers received the day before my accident.

Being healthy is more important. Plus you don't want to make your injury worse and end up in a wheelchair.

as the accident took place outside of your agreed attendence times with RM then you have no claim over RM. It will not be classed as an accident during work time.
However as you're under the DDA i would be questioning the stage warnings for your attendence if these are the cause of your absence.

Get your rep involved asap, if you don't have one, call the local branch and get the area rep involved

are you sure there are no claims while i am travelling to work if something happen on the road outside of shift times?

Depends on the circumstances and cause of the accident there is no hard and fast rules but 3 for instances all outside work hours.

1. Run over by a speeding Royal Mail van - Yes.
2. Slipping while wearing RM footwear and the footwear can be found to be at fault - Possibly.
3. You see glass spread across the pavement and walk straight over it = No.
