As a supplementary question brother fishtank do all your DO vehicles including any hired vehicles used in the workplace for delivery purposes have the necessary no smoking signage in them and if not why not!

Well brothermagrew certainly all of OUR vans carry the appropriate signage however the hire van pictured which only came in yesterday,i have no idea.

"Smoke free" vehicles
The law will require any vehicle that is used by more than one person in the course of
paid or voluntary work to be "smoke free." Smoke free vehicles will have to display nosmoking
signs in the passenger compartment. It will be illegal to smoke in them at any
time – not just when there is more than one person in the vehicle. Work vehicles do not
have to be smoke free if they are exclusively used by a single driver who never carries
passengers in the course of paid or voluntary work. If you manage or operate smoke
free vehicles, you will have a legal responsibility to ensure that the required no-smoking
signs are in place. It will be the legal responsibility of anyone who drives, manages or is
responsible for safety on a vehicle to prevent people from smoking in it.

What do I do checklist

Employers, managers and those in charge of smokefree premises and vehicles will need to:

* display 'no-smoking' signs in smokefree premises and vehicles
* take reasonable steps to ensure that staff, customers/members and visitors are aware that premises and vehicles are legally required to be smokefree
* remove any existing indoor smoking rooms
* ensure that no one smokes in smokefree premises or vehicles

Think you have been in the cupboard to long sister with regards to Scotland the ban came into effect at 6am on Sunday March 26, 2006 and yes RM drivers in workplace vehicles are not allowed to smoke in them.

Failure to comply with the law will be a criminal offence. Individuals may be fined a fixed penalty of £50 for smoking in no-smoking premises. The manager
or person in control of any no-smoking premises could be fined a fixed penalty of £200 for either:

– allowing others to smoke in no-smoking premises
– failing to display warning notices in no-smoking premises

Refusal to pay or failure to pay may result in prosecution and a fine of up to £2,500.

No-smoking signage for vehicles:
You are also required by the law to display ‘No Smoking’ signs in or on any vehicles that are affected by the ban in such a way
that the signs can be seen and read by persons who are in the vehicle, as well as persons approaching the vehicle in question.
The reference to vehicles includes trains, buses, taxis, private hire cars and any vessel, boat or hovercraft. There’s no legal
requirement on the size of these signs but they must still meet certain requirements.
The minimum signage requirement under the new law for any relevant vehicles is a ‘No Smoking’ notice which:
• States that the vehicle is no-smoking and that it is an offence to smoke there or knowingly to permit smoking there.
• Displays the international ‘No Smoking’ symbol.
• Displays the holder of a particular post (e.g. the manager) to whom a complaint may be made by anyone who observes someone smoking.

Basically, the ban covers all vehicles used for transporting the Public or which are used by more than one Employee. So if, for example someone has a Company Car, and never transports other Employees, they can smoke in it. But the RM vehicles are used by more than one Employee, so it's illegal to smoke in them.

I'm surprised that none of them have been pulled by the Police yet, if it's still common practice to smoke in them where you are Motherhubbard. It's happened in other areas.
